Fighting Road Harassment: How to Take Action

MCBC works with the Marin County District Attorney (DA) and California Highway Patrol (CHP) to ensure cyclists have a clear process to report and prosecute road harassment effectively.

To hold motorists accountable, call 911 immediately after an incident, then follow up with a written police report.

Tip: Video footage is crucial in determining whether a case can be prosecuted. Forward and backward-facing cameras mounted on your helmet or bike lights provide critical evidence for law enforcement.

What to Do If You Are Threatened or Harassed

1 – Identify the Perpetrator

  • Be able to physically describe the driver.
  • A vehicle description alone is not enough for prosecution.

2 – Note Key Details

  • Time, date, and exact location (mile markers, intersections, landmarks).
  • Weather, road conditions, and visibility at the time of the incident.
  • Take notes and photos if possible.

3 – Call 911 Immediately

  • Report the incident as soon as you can safely do so.
  • If you leave the scene, visit a CHP office or request an officer to take your report at home.
  • Prompt reporting increases credibility and improves chances of prosecution.

4 – File Your Report First, Then Share

  • Do not post photos or videos online before filing a police report.
  • Sharing details publicly before law enforcement documents the incident can harm your case.

5 – Use Video Evidence

  • A video recording is often the most persuasive evidence in a prosecution.
  • MCBC recommends using forward- and backward-facing cameras to document incidents.
